Terms of Service

1. Acceptance of Terms

By accessing or using Audixa AI (“Service”), including our website, dashboard, and text-to-speech API, you agree to these Terms of Service. If you do not agree, you must discontinue use of the Service.

2. Eligibility & Account Requirements

• You must be at least 13 years old to use the Service.
• You must provide accurate and complete information when registering via Google, Discord, or email/password.
• You are responsible for maintaining the confidentiality of your account and API keys.
• You must immediately notify us of any unauthorized account activity.

3. Commercial Usage Rights

You are granted a worldwide, royalty-free license to use all audio generated through Audixa AI for commercial, personal, or editorial purposes—subject to compliance with these Terms.

4. User Content & Voice Cloning

By uploading audio or text to the Service, you confirm that:

• You either own the content OR have full legal rights and permissions to use it.
• You grant Audixa AI a temporary license to process the content solely for generating audio or maintaining your custom voice models.

Instant Voice Cloning: Audio uploaded for instant cloning is encrypted during processing and permanently deleted immediately after single-use.

Custom Voice Models: Audio and embeddings stored for custom voices are kept in encrypted storage and deleted when you remove the voice or stop using the feature.

5. Data Retention

• Generated audio and input text may be stored for up to 7 days for debugging, quality assurance, and user history.
• Billing records, API usage logs, and account identifiers are retained as long as the account remains active.
• You may request account deletion at any time, and all personal data will be removed within 72 hours (excluding legally required records).

6. Acceptable Use Policy

You agree that you will NOT use Audixa AI to:

• Generate or distribute illegal, harmful, or violent content.
• Reproduce real voices without permission or for impersonation, fraud, or deception.
• Break any applicable law or regulation.
• Reverse-engineer, scrape, or attempt to extract underlying models or code.
• Overload or abuse the API through excessive or automated requests beyond your plan limits.

NSFW content is allowed as long as it is legal, non-harmful, and not involving minors.

7. Analytics & Tracking

Audixa AI uses PostHog and Google Analytics to understand product usage and improve service performance. These tools may collect anonymized device data, interaction events, and website activity.

8. API Credits, Billing & Payments

• Paid plans include monthly usage limits defined by your subscription.
• Exceeding your plan limits may result in additional charges.
• API keys must be kept private; misuse under your key is your responsibility.
• No refunds are issued for plan purchases or API credits unless explicitly stated in a custom agreement.

9. Intellectual Property

All software, code, UI, branding, and underlying models used by Audixa AI remain the sole property of Audixa AI. Users receive a license to use outputs but do not gain ownership of backend systems or models.

10. Termination

We may suspend or terminate accounts that:

• Violate these Terms
• Misuse or attempt to abuse the API
• Cause harm to the platform or other users
• Are involved in fraudulent activity

You may request account deletion at any time by contacting support@audixa.ai.

11. Disclaimers

Audixa AI is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted service, perfect accuracy of generated audio, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, Audixa AI is not liable for:

• Loss of data, revenue, or business opportunities
• Service interruptions or outages
• Actions taken based on generated audio or text
• Misuse of the Service by a user

13. Governing Law

These Terms are governed by and interpreted under the laws of India, unless otherwise required by your local jurisdiction.

14. Modifications to Terms

We may update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the new Terms.
